In viral video, Ms. claims that Duke Doctor has abused her mother :: Wral.com

A Facebook Live video about an experience in the Duke Regional Hospital in Durham was viral with more than 20,000 views and 22,000 comments.

Barnes claims that after asking another doctor for her mother, Duke threw her out of the hospital. After two more days, Barnes said that the hospital allowed her back on the premises.

Barnes, who said she used to work in the hospice supply, understands that doctors have to deliver bad news, but believes that it should have been delivered with more sympathy.

“I have the feeling that it could have been done differently,” said Barnes in an interview about Wral Investigates. “She just said again and again: 'You know, I only tell you the truth.'”

Wral Investigates asked Preston Lesly, a lawyer of James Scott Farrin in Durham, whether the patients have the right to apply for a new medical provider.

“In general, yes,” said Lesley. “This is not only in the law of North Carolina, but also in ethics that the medical providers governed here.”

Lesley referred to the law of the state's informed declaration of consent and explained that they can choose another provider if they did not agree to a certain medical treatment.

Lesley also explained that he believes that the rights of the Duke Health patients further reaffirm this right.

“A patient has the right to look for another provider or, as many people call it, a second opinion,” he said.

Lesley said an inquiry to change the provider should normally come from the patient and not from the family member. That may not have happened in Barnes' situation.

“When the patient is of a healthy mind, the providers typically shift to the patient he treats,” he said.

Barnes said Wral that she was important to comment on the name of her mother and she hopes that others will do the same.

Barnes said that only days after the doctor claimed that her mother would not make it out of the hospital, she was released and is fine.
