A 43-year-old man was sentenced to 12 years in prison because he had fatally beat his 11-year-old son to discipline him because he hadn't done his homework.
The district court in Incheon condemned the judgment on Thursday. The perpetrator was convicted of child abuse, which led to the punishment of crimes of child abuse in the context of the law on special cases.
The court also ordered the perpetrator to complete 40 hours of a child abuse treatment program and to work him in a facility in connection with children for five years after his release.
“The accused hit the victim with a baseball bat under the pretext of the discipline,” said the court. “He continued the attack, even when the child tried to flee pain.”
The court added that “the child had probably suffered extreme pain and that the defendant clearly used indiscriminate violence against a small child. The crime occurred at home – a place where the child was certainly the safest – the particularly outrageous nature of the offense reflects from his father.”
However, the court said that it “had taken into account that the accused had admitted the indictment and that the victim's mother had not punished him.”
The prosecutors had applied for a 10-year sentence in the last month last month: “In view of the physical build of the accused, 180 centimeters [5-foot, 9-inches] Large and 100 kilograms [220 pounds] – The violence was serious and the crime grave. Nevertheless, we considered the family request. ”
The incident occurred on January 16 in an apartment in the Yeonsu district, Incheon. The father was charged to beat his son in fifth grade with a baseball bat, which led to the child's death.
The next morning the perpetrator called emergency services and said: “My son does not breathe.” Medical offenders found the victim covered with blue spots and stormed him into a general hospital, where he died of traumatic shock.
An autopsy carried out by the National Forensic Service came to the conclusion that there was a causal connection between trauma and death.
The perpetrator reported that he had made the victim to discipline him because he did not do his homework.
During the trial, the accused advocated forbearance and said: “I disciplined him from a feeling of parental responsibility when he continued to reveal. I never imagined that he would die.”
The victim's mother, a woman in the thirties, was also examined because he supported child abuse and favored what led to death but was released by charges. She had brought her two daughters to her younger siblings before the incident and was not aware of how it was the extent of violence after his return and went to bed because the situation was not serious.
