Relatives of the family who was killed in San Francisco West Portal Crash -Crash -Aktenlagen against the driver for moving capacity

San Francisco (KGO) – A new lawsuit was submitted against the driver that collapsed and killed in a young family of San Francisco, which was waiting for a bus last year in the vicinity of West Portal.

The lawsuit claims that the 80-year-old driver, Mary Fong Lau, had secretly transferred assets to protect them from a legal disputes submitted by the extended family of the victims. It claims that Lau deliberately pulled three properties out of her trust in order to avoid that they are included in the legal dispute on the wrong death.

“We decided that we submit a lawsuit to reverse these transfers, bring them back to their control and also ask the court, potential behavior & Coll, LLP.

In July 2024, the district prosecutor of San Francisco Brooke Jenkins Lau accused Lau for four cases of crime vehicles.

“Apparently she has her only defense in the fact that the vehicle gave a mechanical failure. In June 2024, the victims' families submitted an illegal death penalty. This civil lawsuit is put on hold until the end of the criminal proceedings.

We asked the UC law professor David Levine whether the transfer of assets during this process was legal.

“If what the family claims is close to true truth, the answer is no, that is not legal,” said Levine. “What she is afraid is that there will be a judgment against her. The judgment will be so great that the insurance policy for the car that it drove will not be enough to pay the judgment, and then the family of the person who died is taken in the case of the judgment issued and then tries to collect against other assets.”

Lau recently changed the lawyers. The victims' lawyers see this as a further step towards delay.

“Your lawyer in her name said again and again that they took more time, they needed more time. And they recently changed the lawyers, which further delayed the criminal proceedings. This campaign of delay added to the idea that she in no way took over our view in any way to take responsibility for death.

With regard to the transfers, Laus new lawyer Seth Morris confirmed that the transfers have occurred and sometimes said:

“While Ms. Lau was advised to reorganize her ownership stocks in the months after the accident, none of these transfers should withdraw potential damage from this heartbreaking event,” said Morris.

Jenkins could not talk about the ongoing criminal proceedings, but generally explained why some cases may be delayed.

“Unfortunately, this is not unusual, and we tend to see in more serious cases that we are dealing with like murder and very serious sexual assault, often when our evidence is very strong. It is a defense tactic not to become cooperative or that we have an overview to make defense stronger,” said Jenkins.

“Ms. Lau now has a committed right -wing team that provides her the best possible guidance and intends to fully cooperate in the criminal and civilian cases that were submitted against her. She also mourns the accident in which she was involved, and the losses of all.”
