Federal judge orders the Trump government to return a Guatemalkish man who has been deported to the USA in Mexico

A federal judge ordered the Trump government on Friday to facilitate the return of a guateman man, whom she was deported to Mexico despite his fear of being injured there.

The gay man who had returned to his home country as part of a US immigration judge. But the United States put it on a bus and instead sent him to Mexico, a distance that the US district judge Brian Murphy probably “lacked to” appear to have a proper procedure “.

Mexico has now brought him back to Guatemala, where he is hidden according to court documents. An earlier legal proceedings found that the man identified by the initials OCG risked persecution or torture when he had returned to Guatemala, but he was also afraid to return to Mexico. He presented evidence of raping there and capturing for ransom while looking for asylum in the USA

Court documents stated that the Guatemaltec man said that he was only told about his deportation to Mexico, essentially when it happened and he asked to speak to his lawyer, but was refused.

“Nobody ever proposed that OCG represents any kind of security threat,” wrote Murphy. “In general, this case shows no special facts or legal circumstances, only the banal horror of a man who was wrongly loaded into a bus and sent back to a country in which he was supposedly only raped and kidnapped.”

OCG entered the United States in March 2024 without prior approval. The man told the man who asked about asylum, was denied an interview and shortly afterwards to Guatemala. In April 2024, OCG decided to try again, and crossed Mexico, where he said, he said, raped and held hostage until a family member paid ransom.

In May 2024 he arrived to the USA and was transferred to an asylum officer after expressing fear of returning to Guatemala. The official found that he was a credible fear of persecution or torture and only initiated the procedure for holding back. Two days later he was sent to Mexico, as court documents show.

A message that was looking for a comment was left behind at the Department of Homeland Security.

Murphy's command contributes to a number of findings by federal courts against the recently published deportations of the Trump management. These have other deportations to third countries and the incorrect deportation of Kilmar Abrego GarciaAn El Salvadoranian who lived in Maryland for about 14 years and a family of Großzog.

The Supreme Court of the United States ordered the Trump government to facilitate the return of Abrego Garcias from A to the USA infamous Salvadoranian prisonThe claim of the White House rejected that it could not bring him back after incorrectly deported it. Both the White House and the President of El Salvadora said they were powerless to return it. The Trump government tried to call it up State Secrets privilegesAnd argue that the publication of details before the open court – or even to the judge privately – would endanger national security through the return of Abrego Garcia to the United States.

In his judgment on Friday, Murphy nodded the dispute over the verb “relief” in this and others and said that the return to the USA is not so complicated.

“The court found that” relief “should wear less luggage in this context than in several other remarkable cases,” he wrote. “OCG is not stated by any foreign government. The defendants have refused to provide an argument that the facials of the government hinder the goals of the government.”
