The judge of the US district court, Fernando Rodriguez Jr., is the first judge to decide that the law on alien enemies cannot be used against people who claim the Republican administration, gang members who march in the United States.

“Neither the Court of Justice nor the parties question that the executive can lead to the detention and removal of extraterrestrials that do criminal activities in the United States,” wrote Rodriguez on Thursday. However, he said “the appeal by the President by the AEA through the proclamation exceeds the scope of the law and contradicts the simple, ordinary importance of the conditions of the law.”

In March, Trump published a proclamation in which the Venezuelan gang tren de Aragua entered the USA.

The extraterrestrial enemy law was only used three times in US history, most recently in World War II when it was cited to internal Japanese Americans.

The proclamation triggered a flood of legal disputes when the government tried to send migrants who claimed that gang members were in a notorious prison in El Salvador.

Rodriguez's decision is important because it is the first formal permanent decision against the administration of the AEA and claims that the president abuses the law.
