The couple left Oaklee's 7 -month -old brother in Indianapolis shortly before Oaklee's death in Indianapolis and informed Waters' family that they had to plunge the girl after falling into the emergency room. The fears before Oaklee's state caused family members to notify the authorities.

Waters was arrested in Colorado in March 2023 for an arrest warrant for domestic abuse in November 2022, in which both allegations of abuse against Oaklee and Marshall were accused.
