New report accuses us in Anastasio Hernandez-Rojas' death in 2010 at the border

San Diego (KGTV) -A new report by a human rights commission has shown that the US and local border officers were responsible for the death of a man in the San Ysidro entrance port in 2010.

ABC 10 News has dealt with the history of Anastasio Hernandez Rojas in the past 15 years.

On Thursday, Alliance San Diego organized a virtual press conference on the report and its results.

In the 43-page report, the Inter-American Commission for Human Rights found that the United States was responsible for the death of Anastasio Hernandez-Rojas.

Rojas died in 2010 in the San Ysidro entrance port, he was beaten and kept in the border patrol. The incident was caught in front of the camera.

On Thursday, Rojas' widow reacted to the report and said she was happy and satisfied with her results and asked the government to clarify her husband's name. She says after watching the video about her husband's incident in 2010, she promised him to fight for justice in his name.

The new report found that agents tortured Anastasio, applied excessive violence and carried out an incomplete and biased investigation. The Commission demands that the criminal investigation be reopened.

Rojas' family finally settled with the government for a million dollars, and none of the agents were ever charged. The DOJ closed the 2015 case.

Customs and border protection have sent ABC 10NEWS the following explanation on the case and the new report:

“The events related to the death of Mr. Hernández Rojas were checked by seven separate investigations – local and federal – including a comprehensive investigation by the Ministry of Justice. The conclusion was made that there was no evidence of criminal misconduct. CBP was followed was discredited.

The report takes place when the former head of the San Diego Border Patrol, Rodney Scott, is considered for CBP commissioner. At that time he was the boss in San Diego. Wednesday, Rodney Scott insisted on the Senate hearing that he had not affected the investigation.

ABC 10News has also contacted the Ministry of Justice about the new report, but has not heard anything.
