Key moments from the fourth day of the process in Patrick Lyoya's death

Grand Rapids, me. – The fourth day of announcement in the trial against the former officer Christopher Schurr began with the continuing testimony of the defender Grand Rapids Police Captain David Siver.

Schurr was charged with the second degree murder after Patrick Lyoya, a 26-year-old Congolese refugee, was shot during a traffic stop in April 2022.

Cross -interpretation of captain Siver

The public prosecutor of Kent County interviewed Siver in cross -experiences after Siver announced the jury on Tuesday that Schurr was appropriate for the use of fatal violence.

Judge Christina Mims read a question from a juror who was able to answer Siver.

Juror question: “Is fatal strength in situations of active resistance or only active aggression in situations?”

Siver: “Active resistance that you cannot always say, but would most likely not lead to a fatal violence.

Captain Chad Mckersie's certificate

The next witness called by the defense was captain Chad Mckersie at the Grand Rapids Police Department, who discussed what it was like to become Tased.

“Incredibly painful,” said Mckersie.

Mark Dodge (defender): “Was officer Schurr in this situation appropriate to use fatal violence?”

Mckersie: “Yes, I believe in my opinion that he was afraid that this device would be used against him. He would be out of operation, he is already exhausted at that moment.”

The public prosecutor rejected this statement and argued that Mckersie could not testify what Schurr believed.

The judge agreed to the public prosecutor and made the comment from the protocol.

The next witness called by the defense was officer Jason Gady at the Grand Rapids police department.

Expert statements by Lon Bartel

The eighth witness of the defense is Lon Bartel.

The judge allowed Bartel to testify as an expert in exhaustion and effort factors.

Bartel gave up his opinion on Schurr's state after the physical struggle with Lyoya.

“Is then at a point at which it is exhausted and has very little options than the use of fatal violence to stop the ongoing attack,” said Bartel.
