The right -wing expert burdened a viral video of reported racist losses compared to the child

Rochester, Minn. (KTTC) – In view of a viral video in which a woman was recorded who reported racist pollution against a boy in a Rochester park, KTTC checks a potential legal recourse for one of the parties involved.

The Rochester police authority said that she actively checked the incident.

The video triggered the discussion online about whether the language in the video could be seen as hate speech or not. The expression “hate speech” is even said in the video.

The lawyer Joe Tamburino based in Minnesota, who is not related to the case, explained that hate speeches have no true definition that makes him illegal. A common definition of hate speeches is if they say something derogatory about another person due to their breed, ethnicity or religion.

Tamburino said that there is any kind of legality, it must contain any kind of combat words.

“Our US constitution and our constitution of Minnesota protect. Even very negative, very harmful language protects this. The only kind of speech against which is not protected is whether they had a kind of violence with it, or it was a kind of combat words that bring them into the field of disorganized behavior,” said Tamurino.

As Tamburino explained, you can say derogatory terms. It is a right that is protected by the first change.

However, what they cannot say and the indictment of disorganized behavior is against words. Fighting words are words or phrases that would probably carry out a person to react physically.

“What the police tries to see if something else happened to see if there are any threats. Was there any threats from physical damage or a weapon? I am sure that this is part of the examination to see whether there is something else apart from the strong words [and the] Hasser -filled words, ”said Tamburino.

Tamburino said that the person behind the camera cannot publish a recourse for the record of the video and then on social media, as it was accepted in public.
