Nintendo sues the accessory company for the course of Switch 2 to sell more products

The accessory manufacturer Genki leaked the Switch 2 by showing some peripheral devices for the console before it was publicly announced at CES Tech Expo, and now Nintendo is for it.

Although the existence of Switch 2 has been known for some time, the real first look at the console did not come from Nintendo itself, but from the peripheral and the accessory company Genki.

They showed a version of peripheral devices from third -party providers that they developed for the console, and the company had early access to the console that Nintendo did not give them. Genki even admitted.

As a result, they sue the company because they allegedly stolen early console models and use them to promote their product.

Nintendo sues Genki to run out of Switch 2

Although the Switch 2 had only been officially unveiled for about a month at the time of writing, it has certainly been in the hands of developers for much longer.

The support of third -party providers this time is a big focus for Nintendo.

However, Genki was not on the list. The only way for you to maintain the console and publish detailed renders from what the final version actually looks like would be to illegally acquire specifications for the console.

As a result, Nintendo throws the book on her and brings it directly to court.

The full lawsuit shows several screenshots from Genki, which teases the switch 2 months before Nintendo's official unveiling with the console to attract customers. They also used their peripheral devices on a Switch 2 console model to advertise their product and had designs prepared for the moment that Nintendo announced it.

Nintendo showed several examples of Genki who anchored the Switch 2 on social media in their complaint

Nintendo sues you on the basis that you have not only received access to the Switch 2 design if you shouldn't, but also that you try to actively compete with you by loading the deck and confusing customers that Genki has worked with you directly.

“Since Genki was not authorized by Nintendo to access the preliminary publication models of the latest Nintendo console, it is unlikely that Genki had ever had access to an authentic Nintendo switch 2 and otherwise made its representations open to the public.

“Since the compatibility with the Nintendo Switch 2 is certainly a threshold requirement for consumers who want to buy accessories for use with the Nintendo Switch 2, this wrong presentation is essential for consumers' purchase decisions.

“Unless these accused are held back by this court, they will continue to cause an irreparable violation of the plaintiff, the public and the Nintendo consumers, for which there is no reasonable legal remedies.”

Nintendo Switch 2 directly

After that, Nintendo outlined everything they are suing: Federal brand injuries, unfair federal competitions of the federal government, false promotion of the federal government, California brand injury and unfair competition and statutory unfair competition under California law.

Nintendo of America demands that Genki not only stops making accessories for Switch 2, but also to revoke all of your rights to distribute products for the Switch. 2. Everything you have in stock should be destroyed according to Nintendo.

In addition, they pursue “correction advertising” to ensure that people know what the Nintendo products of the initial providers are. You want Genki to pay all legal fees from Nintendo, and you demand all profits that you see as false advertising addressed to Nintendo.

It is worth noting that this suit must still be seen by a trial version and that Nintendo does not guarantee. There is also the possibility to choose from court instead. At the time of writing, all Genki Switch 2 products are still live on their website.
