Hearing for the man who is accused of kidnapping a toddler at Acworth Walmart

Atlanta, Ga. (Atlanta News first) – A man who is accused of kidnapping an toddler at an Acworth Walmart will be in front of a judge on Tuesday.

The 56 -year -old Mahendra Patel from Kennesaw was arrested in March, after a mother said that Patel had packed her child in the shop.

Patel's lawyer Ashleigh Merchant claims that he only tried to help the mother, who drove two children on a disabled shopping cart.

The dealer argued that the video of the incident in the Walmart was very relevant for the hearing.

Merchant said two witnesses, one of whom is a Walmart employee, said they had not seen any kidnapping. One of the witnesses said he had seen something, he had entered, Merchant told the court.

The dealer also addressed the earlier conviction of Patel to a crime of class E, of which she said that it is the “least serious of all federal crimes”, and he paid all the fines he had issued. She also said Patel had a ruthless indictment and there is a pending dui less safe case from this year, which she said it was a case without a test.

Previous reporting: According to the lawyer, Acworth Walmart is a “complete misunderstanding” kidnapping case.

According to a report by the acworth police report, Patel turned to Caroline Miller in the shop and asked for help in finding Tylenol.

Merchant said that when Miller was out of the car, her client turned to keep the child on Miller's lap.

According to the mother, she and Patel played “Tug of War” before he let go of and left.

Patel showed the surveillance video a few minutes later with a Walmart employee and went to the Tylenolgang. He is then seen by Miller on the way to appearance and seems to show her that he found medicine.

About 30 minutes later, Miller calls 911 and tells the operator what she believed that he had taken place.

“I had to tear my baby out of another man's hands because he tried to grab it,” said Miller to the 911 operator. “Everything happened so quickly and he was not in the shop, and when I spoke to the manager, he went off.”

Patel was arrested and charged with kidnapping, assault and battery fees. A hearing will take place on Tuesday at 11:30 a.m.
