Court observation: Defense criticizes the deposit decision for unlikely woman

Woodland, CA -Potz The proof of judicial requirements made judge Clara M. Levers a deposit on Monday to $ 5,000 for a woman who was accused of drug-related crimes. The decision was followed by a lengthy argument from the defense and objection of the public prosecutor, in which the past cited the past of women as proof of “poor performance in probation”.

The woman is raised with several charges in connection with the possession of illegal substances and an improvement due to allegedly against the criminal offense against the deposit. According to her public defender, she had complied with the probation conditions, including participation in court appointments and the indictment of her GPS monitor – a claim that was supported by the documentation submitted in court.

The deputy district attorney Alvina Zhang argued against the release, citing the history of the woman. Zhang insisted that she had received several opportunities and did not claim that this behavior pattern was a risk of public security. “It is a threat to public security,” Zhang told the court and asked the judge to maintain the deposit.

In response to this, the deputy public defender Aram Davtyan questioned the state of the public prosecutor's narrative. “The claim that she did not report on the probation is simply not true,” argued DAVtyan and explained that the defendant had actually reported “at least four times”. He submitted documents to confirm the claim and emphasized his client's challenges as someone who had homelessness.

DAVTYAN recognized the difficulty of complying with the terms of probation under such circumstances, in particular the logistical challenge of calculating a GPS monitor while being directed. “It is difficult for our most unhealthy customers to charge the GPS,” he noted.

He also questioned the structural obstacles that make it difficult for people in poverty to meet the legal requirements. “As a company, we could have created a system to bring it to court,” said Davtyan. “Instead, we made it very easy for police officers to arrest them.” His comments underlined the broader tension between the expectations of the criminal legal system and the realities of navigating without stable living space or access to services.

While the public prosecutor claimed their focus on the earlier records of the woman, the defense asked the court to examine the systemic errors that contribute to non -compliance. Davtyan emphasized that the difficulties of his client in the context of poverty and lack of support should not be understood to be a willful disregard of the law.

Ultimately, the judge levers on the public prosecutor's side and explained that due to the history of the accused and a risk assessment carried out by the court, the “bail is required”. The deposit was set at 5,000 US dollars, so that the woman was in custody up to another procedure.
