Effectard scandal: The lawyer of the senior plaintiff resigns

Munich (dpa -afx) -The case of the WirCard model in relation to the claims for damages of tens of thousands of shareholders is still turbulent: the leading lawyer of the plaintiff Peter Mattil has resigned from the case, as the lawyer announced. The reason is obvious disagreements in a second model of the plaintiff. The strategies of the two law firms are “not compatible”, wrote Mattil in his short explanation.

The model case in front of the Bavarian Supreme Regional Court should clarify whether the shareholders of the vibrations are entitled to compensation. The main goal of the complaint is the auditing company EY, which tests the annual financial statements of the company listed by Dax, which collapsed in 2020. According to general estimates, there is not much money to attribute the former CEO of Wircard, Markus Braun, and other former managers of the insolvent payment service provider.

The senior plaintiff lost half a million euros

The court's first civil senate chose a Hessian banker who lost half a million euros with Wircard Securities as a senior plaintiff. At the end of last year, almost 8,700 investors submitted claims for damages and another 19,000 claims without taking legal action themselves.

The court has already subdued hopes

However, it was obvious right from the start that there were disagreements between the lawyers involved in the test case. Apart from that, the Bavarian Regional Court dampened the shareholders' hopes in February: In the case of a preliminary decision, it was found that no claims for damages against EY could be submitted to the model case for capital investors. However, the Senate expressly pointed out that the shareholders could assert their claims in separate legal proceedings.

The model procedure takes place in parallel to the criminal trial for Wircard, in which Braun, who has been in court for almost five years, and two co -accused have been on trial since December 2022 for gang frauds and other allegations. /Cho/dp/jha
