The Utah's Supreme Court took up murder in 1985, orders a new procedure for the death of death

The Utah's Supreme Court ordered a new procedure for a man who has spent almost 40 years in the death cell.

On Thursday, May 15th, the court announced that Douglas Stewart Carter's conviction and death sentence from 1985 would take place and a new procedure would take place.

The Court said that the decision was made on the wrong statements that were presented by Carter's original process, which was rejected by someone who was involved in the case.

They came to the conclusion that this violation undermining their trust in Carter's accuracy and his punishment.

More about Douglas Stewart Carter:

Carter was arrested on April 11, 1985 for murder of Eva Olsen, who was killed in her house in Provo. Olsen was found by her husband with several stab wounds and a gunshot wound on the head.

According to court documents, the police received two tips in the weeks after the murder, which Carter identified as potential suspects. About a month later, when Carter and his wife divorced, she told the police that he might have used her pistol that had disappeared on the night of the murder. The weapon was identified as a .38 special pistol – the same model that was recovered as evidence on site.
