In the lawsuit, which was submitted in front of a federal court in Little Rock, Maria “Maer” Malinowski accused the ATF and 10 agents and task force officials against their and the constitutional rights of their husband.

In the lawsuit, damage not specified is submitted and a legal proceedings are requested.

“The constitution requires appropriateness and in particular here that the defendants announce and announce their presence and purpose and wait a reasonable time before admission,” says the lawsuit. “The ATF did not do this, which led to a completely predictable, unnecessary and tragic result.”

The ATF said it did not comment on ongoing laws.

A local prosecutor said last year that an ATF agent was justified to fatally shoot Bryan Malinowski. Malinowski's death led to the criticism of some Republican legislators in Arkansas who have asked for further information from ATF.

Malinowski was a lifelong weapon collector who visited shows on weekends where he bought, sell and act with others, the lawsuit said.

He did not know that he was being examined and sensibly believed that the agents who entered his house were intruders because they did not knock and gave him a reasonable time to get to the door, the complaint said.

“Today's lawsuit is looking for justice for the nightmare that I have been living for 14 months,” said Maria Malinowski in a press release.
