Indiana State prison is sued to allow spiritual consultants when executing

The lawsuit has the potential to change the Indian law in terms of spiritual advisors during the executions when it is successful in court

An inmate in Indiana Death Row has filed a lawsuit against the leaders of the state of Indiana and argues that he had the right to have a spiritual consultant present during his execution.

Benjamin Ritchie is to be executed on May 20th before sunrise next week. The rules of the prison presented that the spray consultants had to leave prison at 10 p.m. Ritchie's lawsuit is trying to “have his spiritual consultant in the facility chamber, with him before and at the time of his execution, to pray with Mr. Ritchie, to confess to sacred communion and put hands on him.”

The lawsuit is also requested for an execution papers, while the case is taking place in court. Ritchie was convicted in 2002 for the murder of the police officer of Beech Grove in 2000. It was only this week that Indiana Governor Mike Braun announced that he would refuse the recommendation of the State Parole Board of Indiana and Ritchie's application for terminals.

His lawyers previously argued that Ritchie had ineffective advisory support during his first legal procedure because she could not examine the full effects of a disturbing disturbing fetal alcohol spectrum for his criminal behavior.

Ritchie's last hopes are resting at the US Supreme Court, where his lawyers submitted a petition for a stay in the presentation. His chances are even slimmer with the Supreme Court of Justice, as it receives thousands of petitions every year and only hears in about 80 oral arguments.

However, if it is successful in court, his lawsuit could change the law of the state of Indiana.

The law is on our side, we really believe that “the deputy public defender Mark Koselke shared in a recent interview on News 8.

His lawyers previously argued that Ritchie had ineffective advisory support during his first legal procedure because she could not examine the full effects of a disturbing disturbing fetal alcohol spectrum for his criminal behavior.

However, the states pretended these arguments and said Ritchie's mother's drinking during pregnancy was brought up during his trial of 2002.

Tyler Banks of the Attorney General of Indiana recently said in a hearing of grace: “His process lawyer could not have been ineffective because he was not a diagnosis that did not exist at this point.”

The case of the Supreme Court does not evaluate whether Ritchie had brain damage through FASD or whether he had ineffective support from the lawyer, but whether the current assessment of Indiana on ineffective lawyer corresponds to the federal standards.

“BUND, you actually have to check the lawyer's performance. You have to check whether a mistake has been made,” said Koselke. “But on our level in front of the dishes of Indiana, they only check whether someone was in the courtroom with the accused.”

If the Supreme Court decides to remain the execution and to hear Ritchie's case, there should be a hearing of evidence that would at least temporarily hire its execution.
