Five sent in a year in prison for theft; First conviction for Petty organized crimes under BNS | Mumbai News

Mumbai: A judicial court in Girgaon sentenced five men to one year of strict detention and imposed a fine of £5,000 for theft of mobile phones during the Ganesh immersion in 2024. This marks the first conviction in Mumbai in accordance with Section 112 of the Bharatiya Nyaya Sanhita (BNS), which expressly organized with Petty – a new category that was introduced into the revised criminal code.

Section 112, which was added to the BNS in 2023, defines Petty organized crimes organized as theft, snapping, fraud and similar crimes committed by a group or gang.

The case was registered after a 39-year-old man, Baser Shaikh, reported his phone in the middle of the crowded immersion processes on September 20, 2024. During the day, several people approached VP Road Police with similar complaints.

The deputy police commissioner Mohit Kumar Garg (Zone 2) formed a special examination team that carried out CCTV film material from Girgaon Chowpatty and the surrounding area. The examination led the team to several locations in Maharashtra and Gujarat, where the accused was pursued and brought to Mumbai to interview.

Five people were finally arrested: Sanjay Raman Kharwa, Sanjay Suresh Kharwa, Sumesh Rajendra Lohkare, Laltu Tunu and Akash Vijay Mehra. The gang allegedly stolen 42 mobile phones and a two -wheeler, all of which were recovered by the police. The investigators showed that the group used the chaos of the festive crowds to systematically carry out the thefts.

All five defendants are inhabitants of Kamathipura and Girgaon. Based on the FIR, they were booked in accordance with Section 112 and Section 303 (2) of the BNS. The process began shortly after the indictment sheet was submitted, whereby the new legal framework procedures, including the restriction of unnecessary witness crossings, rationalized.

“This is a groundbreaking case that is the first conviction in accordance with Section 112 of the BNS in Mumbai. It underlines the intention of the law to interfere with organized petty crime, which disturb public order, especially at large events,” said DCP Garg.
