Washington (AP) – A federal judge has decided that US officials have to maintain custody and control over migrants who were apparently brought to South Sudan if they illegally order their distances.

The US district judge Brian E. Murphy in Massachusetts issued the judgment late Tuesday after an emergency negotiation, after the lawyers said for immigrants to deport the Trump government to deport people from Myanmar and Vietnam to the South Sudan -despite a judicial order to restrict distances to other countries.

Murphy said that the government had to “maintain custody and control of the class members, which is currently laid down to South Sudan or to another third country, to ensure the practical feasibility of the return if the court found that such distances were illegal”.

While Murphy left the details at the discretion of the government, he expects the migrants to be “treated humanly”.

The lawyers of the migrants told the judge that the immigration authorities may have sent a dozen people from several countries to Africa, which they argue that they violate the reason that people have to be given a “meaningful opportunity” to argue that sending to a country outside of their home would threaten their security.

According to court documents, the obvious removal of a man from Myanmar was confirmed by an immigration officer in Texas in an e -mail. He was only informed in English, a language that he does not speak well, and his lawyers learned from the plan hours before his deportation flight.

A woman also reported that her husband from Vietnam and up to 10 other people had been flown to Africa on Tuesday morning, wrote lawyers of the National Immigration Litigation Alliance.

The lawyers asked Murphy for an emergency court decision to prevent the deportations. Murphy, who was appointed by President Joe Biden, previously found that all plans to deport people to Libya without notice, “clearly” violate his decision, which also applies to people who have otherwise exhausted their legal appeals.

Murphy said in his Tuesday order that US officials will have to appear in court on Wednesday to identify the migrants concerned, when and how they found out that they would be brought to a third country and what opportunity they had been given to increase an anxious claim. He also decided that the government has to provide information about the whereabouts of migrants, which have apparently been removed.

The Department of Homeland Security and the White House did not return messages to get a comment.

The police spokesman for South Sudan, Major General James Monday, said the Associated Press on Wednesday that no migrants had arrived in the country and that when they arrive, they were examined and “again specified in their correct country” if they are not south -sudanese.

Some countries do not accept deportations from the United States, which caused the Trump government to strike agreements with other countries, including Panama, to accommodate them. The Trump government sent Venezuelans to a notorious prison in El Salvador after a war law trendy from the 18th century.

South Sudan has suffered repeated waves of violence since its independence from Sudan in 2011. A few weeks ago, the country's supreme official warned that the struggles between the President Loyal forces and a Vice President threatened to hike into the full civil war again.

The situation is “dark of the 2013 and 2016 conflicts, which took over 400,000 lives”, Nicholas Haysom, head of the almost 20,000-strong UN peace mission.

The annual report of the US State Department published in April 2024 in South Sudan states that “significant human rights issues” include arbitrary murders, disappear, torture or inhuman treatment by security forces and comprehensive violence on the basis of gender and sexual identity.

The US Ministry of Homeland Security has given a small number of South Sudanese who have already lived in the United States since the country lived in the USA in 2011 and protected them from deportation, since the conditions for returning were classified as unsafe. Secretary Kristi Noem recently expanded this protection to November to enable a more thorough review.

The diplomatic relationships of the South Sudan to the United States grew shown in April when a series of deportation led to the revocation of Visa and a ban on the South Sudanese nationals.

The United States is one of the largest donors of the humanitarian aid programs in South Sudan with overall financing in 2024 at over 640 million US dollars, according to the US message in South Sudan.
