The defense argued in the application that the discovery of the state was “extensive and unorganized” what they say, violates Kohberger's right to a proper procedure because the defense had no time to “sensibly check and examine” evidence.

In the same application, the defense also tried to impose additional organizational requirements for the discovery of the state. Oral arguments of the application took place at the hearing of April 9.

Judge Steven Hippler said in the decision that the defendant “has no violation of discovery or a proper violation of the procedure”, which is why the application as a whole was rejected.
