What you say:

According to a criminal complaint, a family member heard a loud bang from a weapon and went into the living room to find the 16-year-old, who kept a weapon and Valladares on the floor and could not breathe.

The prosecutors said that other people who were at home at the time told the investigators that they had heard the shot and saw Valladares on the floor with a gunshot wound. They said the brothers were “close” and the 16-year-old “would not shoot” Valladares.

The 16-year-old said that he played “with the weapon” and Valladares tried to take it because he knew that they shouldn't play with weapons according to the complaint. He said he thought the weapon had security, but she started when the 16-year-old tried to snap the weapon back from his younger brother. He said the shootout was “an accident”.

Court files said hours before the shootout, the family had been in a cemetery to celebrate the birthday of a family member who had previously died.

The public prosecutor said that another family member had told the police that the weapon was “usually not loaded”, but she invited a single ball to shot a shot in the cemetery. The shot was never fired, she said, so there was a ball in the gun. She also said she threw the gun into the river.
