Ada County, Idaho – Bryan Kohberger's defense demands that his impending four -way murder process are delayed.

Kohberger is to be brought to trial in August for the murder of four students from the University of Idaho in August. Madison Mogen, Xana Kernodle, Ethan Chapin and Kaylee Goncalves were brutally stabbed in a rental house outside the campus. Kohberger, who faces a potential death sentence when he is convicted of the murders, has retained his innocence.

Bryan Kohberger appears in court for a hearing on November 7, 2024 (Idaho fourth district court)

In an application submitted this week, the defense quotes a recently carried out “Dateline” NBC Special, which was broadcast on May 9 as the reason for the delay. It is argued that the episode violates a GAG order that has existed since 2023. The episode contained video film material, cell phone documents and photos of documents that are not publicly available via official channels.

“The (dateline) repeatedly shows the non -public character of this information and explains that it has been obtained from the name mentioned by name that are close to the examination,” the application said. “A capital procedure in August will violate Mr. Kohberger's constitutional rights because the lawyer needs more time to check the discovery, complete the investigation and prepare for the process.”

The application is less than a week after judge Steve Hippler declared in a hearing before the proceedings that he is open to the appointment of a special prosecutor to investigate potential violations of the long -term non -dissemination order of the Court of Justice. The judge Hippler ordered the public prosecutor and the defender to provide a list of everyone who possibly had access to the previously not reported information about Kohberger's Internet search history and other details in the “Dateline” episode reported the Associated Press.

Kohberger's lawyers expressed concerns about the special and an upcoming book about the case that was in mid -July for publication for publication. Your registration states that the blurb for the book “concludes that the apparent dateline losa was not the only violation of the non-dissemination arrangement of this court.”

“Continuation is necessary to completely investigate the leaks and to alleviate the adverse effects of such an inflammatory pre -judicial public relations work that occurs so close to the current date of negotiation,” says the submission.
