Trumps Doj can let Boeing guilty – and family members of crash victims are not pleased

President Trump's Ministry of Justice burdens whether Boeing (BA) from a criminal proceedings and guilty request for two fatal 737 max.

They say that they consider it a treasure for the aviation giant at the expense of justice and security.

“The message sent to Corporate America is: don't worry about killing your customers,” said Dr. Javier de Luis, a retired aviation and space engineer and with lecturer, his sister Graziella de Luis y Ponce, an interpreter died in one of the accidents. “Simply treat it as costs for business.”

In a criminal culpristed with President Bidens Doj, Boeing admitted that his workers gathered to the regulatory authorities of aviation before the accidents killed 346 people in 2018 and 2019.

Now is the idea that, according to the prosecutors and family members, who took part in a call to Doj officials last Friday, offer Boeing protection before law enforcement for a further 444.5 million dollars from the company in order to be divided between affected families.

The “non -insurance” agreement would end the renewed criminal offense after the public prosecutor's office had revoked a prior punctual law enforcement agreement that they had hit with Boeing in January 2021.

Boeing refused to comment on the proposal. An attempt is scheduled to begin on June 23.

In an update about the case published on May 19, the government also said that Boeing also pays the legally permissible maximum permissible fine, paying compliance improvements and maintaining an independent conformity consultant, but did not decide whether the proposed agreement should be concluded.

The DOJ also said during the call with the families of the victims that it had not made a final decision on the proposal.

Avoiding a criminal conviction would be a great victory for the company and would use Boeing from a criminal trial for the third time, most recently after a federal judge instructed a procedure in June.

Criminal convictions can exhaust or suspend the right of a company to a contract with the federal government and thwart its ability to secure loans.

These consequences are of particular importance for Boeing, which the Federal Government considers as its largest customer and is also the country's largest exporter.

At the beginning of this year, Boeing won a large contract for the construction of a new F-47 jet fighter for the Pentagon. Last week the CEO of Boeing, Kelly Ortberg, accompanied Trump on a trip to the Middle East and thanked the president for the help to convey a 96 -billion dollar order from Qatar Airways.

When he was sitting next to the President at an event, he said: “All of these planes are built in the United States to create a considerable number of jobs.”

Tracy Brammeier, a lawyer of crash victims from Clifford Law Offices, said the current plan that is viewed by the Doj, the most mildest bargain and would reward Boeing with less accountability for his repeated violations.

She added that a process could uncover who is responsible for the death of its customers in the company.

“When it comes to a non -contract agreement, there is no judicial control. It is really a private agreement,” said Brammier. “With a pushed law enforcement contract, it is really postponed, so there is a period in which Boeing still has to answer a judge.”

“They had a criminal who said:” I would like to explain myself guilty because of a crime. “And now suddenly, six or seven months later, the government says that we only decided that they can pay [millions] And we will drop the case, ”added Brammier.

Matthew Yelovich, a former public prosecutor who is now a partner in Cleary Gottlieb's white crime practice, said the Doj has probably decided on the core conditions of the agreement.

“Until the government has reached the point where it invites the victims to put a burden on a solution to this size and complexity, the idea that the government would only give it up is very common,” said Yelovich.

What the government marked as a preferred approach for the victims is most likely the substance of what it will present to the court.

The court's approval is required for the Doj to dismiss the indictment. However, since the judges have a limited discretion to cross the discretion of the public prosecutor, it is rare that such an application is refused.

Another family member of victims who is not satisfied with what is being considered today is Ike Riffel, who has lost two sons, 29, and Bennett (26) in the Boeing 737 Max -Crash by Ethiopian Airlines from 2019 in Ethiopian Airlines.

The recent government proposal, he said, has no way to uncover families to uncover, who know especially at Boeing about the 737 Max deficiencies.

“We have lost all other options we have,” said Riffel, adding that the government's pursuit of Boeing ended up in several fraud by the government. “What I would like to see is a public court proceedings. Who did what? Who said what? Which managers had this whole conspiracy?”

“I want Boeing to return to the gold standard for engineering and security,” said Riffel. “There are many great people we know that they work for Boeing who knew nothing about it. Nobody wants Boeing to fail. We just want to get the rats out of the basement.”

That is reason enough for the judge to reject the deal, he added. “Hopefully he will see through that – that you dangle money in our face.”

Yelovich agreed that a process generally brings more to light.

“One of the major characteristics of our public court system is the public participation in the penalty justice system,” said Yelovich. “It is not only the right of the government to initiate the full power of its evidence, but also for the public, the indictment, the evidence and the defense, which may otherwise not be reflected in a resolution agreement, to have visibility.”

Bremmeier said the families justify their objection to another negotiating agreement will improve flight safety. In January 2024, Boeing still recovered from another fatal aircraft failure when a door connector from a Boeing-tackled Boeing-tied 737 max 9 flies.

“The incident a year and a half ago is a really good example of this,” she said. “It has nothing to do with McAs. It has nothing to do with the accidents they were victims of.”

Riffel said he asked the government's lawyers while calling on Friday.

“I ask the doj to tear this agreement and open the examination again,” he said. “People have committed these crimes, no company … If this non -insurance agreement is accepted, the truth will never be known, and I believe that the truth is very important to ensure that this never happens again.”

“The doj gives Boeing another chance; my sons never had a chance.”

De Luis said the victims suggested that Boeing make a much more important monetary contribution in the “single -digit billions” of dollars.

The means, he said, would only use external safety monitors in Boeing's factory floors for five years in Boeing's factory floors. Monitors are needed, he said, because in his opinion, the FAA is currently not equipped for the complete monitoring of production security.

“People say Boeing is too big to fail. Yes, but it's too big to produce unsafe aircraft,” said de Luis. “We need them to do it better. And they have repeatedly shown that they were left to their own devices, they won't do it better.”
