Man, who was injured in a fatal northwest paso crash, sued Tow Company, driver

A second lawsuit was submitted against a trolley company and its driver

Alfredo Sifuentes, 54, from New Mexico, submitted on Friday, May 16, against the Sheffield Towing-Service, also known as Fort Stockton Towing, and the TOW Truck driver, 28-year-old Alfredo Campos, as court records show.

No lawyers are listed in court files for the Sheffield Towing Service and Campos. Campos was not accused of crime in connection with the fatal crash, as court files show.

Sifuente's “suffered serious and permanent injuries,” said James Tawney, lawyer Tawney, Acosta and Chaparro, who represents Sifuentes in the lawsuit, in a press release.

“Our customer is facing a lifespan of pain, medical expenses and disabilities,” said Tawney in an explanation. “Commercial freight forwarders have a legal obligation to hire, train and monitor safe drivers. If you do not do so, life has endangered and that is exactly what happened here.”

Sifuentes strives for compensation of more than 1 million US dollars for medical care, loss of income and physical and mental suffering. The lawyers are looking for legal proceedings. No negotiation date was determined.

Law claims for negligence on behalf of the driver, TOW Company

Sifuentes was injured on May 8th during a fiery multivehicle wreck at the intersection of the forest bean -Transmontain Drive and the North Desert Road, the lawsuit said.

The crash occurred around 6:20 a.m. when Campos drove a yellow Kenworthy tow truck to drag a halfbruck and a trailer that broke out on the Transmountain Drive, the spokesman for the police authority, det, del Paso. Judy Oviedo wrote in a press release on May 9th.

Campos “for unknown reasons” could not stop the towing car because it approached the intersection of the Transmountain Drive and the North Desert Road, the police said. The tow truck fell into several vehicles that were waiting at a red light at the intersection. The wreck comprised 12 vehicles, which led to death and seven other people who were injured.

Aldo Jenkins, a passenger in the towing car, died in the accident. His family also sued Campos and Sheffield Towing Service. Jenkin's “was killed in the most terrible way that you can imagine and was burned alive in the taxi of the truck,” said the lawyers that his family represented in this complaint.

Sifuentes' complaint claims that the crash was caused by Sheffield Towing Service and Campos by “negligence and gross negligence citing several security regulations of the federal government and the Texas transport laws.

The lawsuit claim that Campos is responsible for causing the crash for various reasons, including:

  • Nothing for the operation of a commercial motor vehicle
  • Non -operation of a commercial motor vehicle with sufficient caution
  • Non -operation of a motor vehicle at a speed that was appropriate and prudent under the conditions
  • Non -control of the speed
  • Default to drive in a single lane
  • Default to keep a proper look
  • Do not draw
  • Do not use braking safely to avoid a collision
  • Default to turn left or right to avoid a collision

The lawsuit claim that the Sheffield towing service is responsible for the crash for several reasons, including:

  • Default to properly educate Campos in fulfilling his obligations, instructed and monitored
  • Default to deliver appropriate and reasonably competent drivers and workers
  • Default to train his drivers in order to pursue motor vehicles in accordance with the law, regulations and regulations of the state of Texas
  • Negligent attitude, selection, monitoring, storage, training and commissioning;
  • It is not possible
  • Default to carry out a training course that corresponded to the industry standards
  • Non -proper security manuals and instructions for drivers
  • Not enforced to enforce its security guidelines

No negotiation date for the lawsuit was determined, as court files show.
